MindmapMD Software License Agreement, Version 1.0. This is the public web copy of the LICENSE file shipped with the extension. MindmapMD ソフトウェア使用許諾契約 v1.0。本ページは拡張機能に同梱されている LICENSE ファイルの Web 版です。
※本利用規約は英語版が正本です。法的解釈は英語版が優先されます。日本語訳は参考として提供しています。

MindmapMD ("the Software") is licensed, not sold. By installing, using, or accessing the Software, you ("the User") agree to be bound by these terms. If you do not agree, do not install or use the Software. MindmapMD（以下「本ソフトウェア」）は販売ではなくライセンス提供されています。本ソフトウェアをインストール・使用・アクセスすることにより、お客様（以下「ユーザー」）は本規約に拘束されることに同意したものとみなします。同意されない場合は、本ソフトウェアをインストール・使用しないでください。

1. Grant of License 1. ライセンスの付与

Subject to the User's compliance with this Agreement, Mau Tanoue (the "Licensor") grants the User a non-exclusive, non-transferable, revocable license to install and use the Software on personal computing devices for personal or commercial purposes, free of charge. ユーザーが本規約を遵守することを条件に、Mau Tanoue（以下「ライセンサー」）は、本ソフトウェアを個人用または商用の目的で個人の計算機器にインストール・使用するための、非独占的・譲渡不可・取消可能なライセンスを、無償でユーザーに付与します。

2. Restrictions 2. 制限事項

The User shall not, and shall not permit any third party to: ユーザーは以下の行為を行ってはならず、また第三者にこれらを行わせてはなりません:

Copy, redistribute, publish, sublicense, sell, rent, lease, or otherwise transfer the Software or any part thereof, except via the official Visual Studio Code Marketplace listing operated by the Licensor. 本ソフトウェアまたはその一部を、ライセンサーが運営する公式の Visual Studio Code Marketplace 経由を除き、複製・再配布・公開・サブライセンス・販売・レンタル・リース・その他の方法で移転すること。
Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying ideas, algorithms, file formats, or internal APIs of the Software, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. 本ソフトウェアのソースコード・基礎となるアイデア・アルゴリズム・ファイル形式・内部 API を導出する目的で、リバースエンジニアリング・逆コンパイル・逆アセンブル・その他類似の行為を行うこと。ただし本制限にかかわらず適用法によって明示的に許容される範囲を除きます。
Modify, adapt, translate, or create derivative works based on the Software. 本ソフトウェアを改変・翻案・翻訳・派生著作物の作成をすること。
Remove, alter, or obscure any proprietary notices, labels, or marks on or within the Software. 本ソフトウェア上または内部に存在する権利表示・ラベル・標識を削除・改変・隠蔽すること。
Use the Software to develop, market, or distribute any product or service that competes with the Software or the Licensor's paid offerings. 本ソフトウェアまたはライセンサーの有料サービスと競合する製品・サービスの開発・マーケティング・配布のために、本ソフトウェアを使用すること。
Use the Software in any manner that violates applicable law. 適用法に違反する方法で本ソフトウェアを使用すること。

3. Third-Party Components 3. 第三者コンポーネント

The Software incorporates open-source components licensed under their respective terms. Such components remain governed by their original licenses and are not subject to this Agreement. License notices for third-party components are preserved within the distributed bundle. 本ソフトウェアは、それぞれの条件の下でライセンスされたオープンソースコンポーネントを組み込んでいます。これらのコンポーネントは元のライセンスによって規律され、本規約の対象外です。第三者コンポーネントのライセンス表示は、配布バンドル内に保持されます。

4. Paid Services (Future) 4. 有料サービス（将来）

The Licensor may offer separate paid online services ("Paid Services") that integrate with the Software. Use of any Paid Service is subject to additional terms presented at the time of subscription. This Agreement does not, by itself, entitle the User to any Paid Service. ライセンサーは、本ソフトウェアと連携する別個の有料オンラインサービス（以下「有料サービス」）を提供することがあります。有料サービスの利用は、契約時に提示される追加条件に従うものとします。本規約のみによっては、ユーザーは有料サービスを利用する権利を取得しません。

5. Telemetry and Privacy 5. テレメトリとプライバシー

The Software does not transmit user data to any server by default. If the User explicitly enables telemetry, the Software transmits a minimal, anonymous data set as described in the Privacy Policy. 本ソフトウェアは、デフォルトでは一切のユーザーデータをサーバーに送信しません。ユーザーが明示的にテレメトリを有効化した場合に限り、プライバシーポリシーに記載された最小限の匿名データを送信します。

6. No Warranty 6. 無保証

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. 本ソフトウェアは「現状有姿」かつ「提供可能な範囲」で提供され、明示・黙示を問わず、商品性・特定目的への適合性・非侵害性、および取引慣行から生じる保証を含む（ただしこれらに限定されない）いかなる種類の保証も伴いません。

7. Limitation of Liability 7. 責任の制限

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 適用法で許容される最大限の範囲において、ライセンサーは、本ソフトウェアの使用または使用不能から生じる、または関連する、間接的・付随的・特別・結果的・懲罰的損害、利益・収益・データの喪失について、保証・契約・不法行為その他いかなる法理論に基づくものであるかを問わず、またそのような損害の可能性についてライセンサーが事前に知らされていたかどうかを問わず、一切の責任を負いません。

8. Termination 8. 解除

This Agreement is effective until terminated. The Licensor may terminate this Agreement at any time if the User breaches any of its terms. Upon termination, the User shall cease all use of the Software and destroy all copies in the User's possession. 本規約は解除されるまで有効です。ユーザーが本規約の条項に違反した場合、ライセンサーはいつでも本規約を解除することができます。解除後、ユーザーは本ソフトウェアの使用を直ちに中止し、保有するすべての複製を破棄するものとします。

9. Governing Law 9. 準拠法

This Agreement shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict-of-laws principles. 本規約は、抵触法の原則によらず、日本の法律に従って規律・解釈されるものとします。

10. Entire Agreement 10. 完全合意

This Agreement constitutes the entire agreement between the User and the Licensor with respect to the Software and supersedes all prior or contemporaneous understandings, whether written or oral. 本規約は、本ソフトウェアに関するユーザーとライセンサー間の完全な合意を構成し、書面または口頭を問わず、それ以前または同時に成立したすべての了解事項に優先します。
